THE request made in December last year for a beach near Point Drummond to become clothing optional was knocked back by the Lower Eyre Peninsula District Council again last week.
The council initially determined the beach to be on unallocated Crown Land and was therefore under the management of the state government.
In a report to last Friday's council meeting, the council's works and infrastructure director, Alex Douglas, said correspondence was received from state environment minister Ian Hunter's office that said the beach was actually under the management of the council.
The decision therefore came back to council by default, which decided against the establishment of a council by-law that would allow unclad bathing at the beach near Point Drummond.
The council decided against establishing the by-law because the costs involved to police the beach were considered to be too high.
"The enforcement provisions would involve the general inspector and local SAPOL officers, and would clearly be subject to their availability and prevailing priorities," Mr Douglas said in his report.
"Staff consider that the establishment of by-laws for an isolated circumstance and the subsequent cost to administer and enforce is not warranted."
