While this is not a nudist issue, it very well could be, it seems that our culture of over-sexuality has become so compounded that, we have crimes for our children... I assume many will have a different opinion on this highly complex issue, but this is a good opportunity to speak on the matter...

Shouldn't this be a Constitutionally protected form of self expression?  Seems to me that it is part of her life, liberty and pursuit of happiness.  Doesn't your Constitution mean what it says?

I am pleased this was caught and stopped.  If she was my daughter, I would have no issue with nude photography in the proper setting and time (akin to the parents of the young naturists in France and elsewhere who happily consented to it with Jock Sturges, David Hamilton etal), but as witnessed on 1000's of tumblrs, once they are out there, they are out there (texting nudes).  She, as 11, is not capable of using proper judgement in this regard. 


That's my view!

I am pleased this was caught and stopped.  If she was my daughter, I would have no issue with nude photography in the proper setting and time (akin to the parents of the young naturists in France and elsewhere who happily consented to it with Jock Surges, David Hamilton etal), but as witnessed on 1000's of tumblrs, once they are out there, they are out there (texting nudes).  She, as 11, is not capable of using proper judgement in this regard.

I think there is an issue with it being a crime for the "victim," she cannot properly consent making her the victim... However in some localities a person who did what she did would be scarred for life via a lifetime on the Sex Offender Registry. Now the individual who received this picture if an adult, should be charged with solicitation of a minor. If the receiver is a minor as well, then the issue is, as I stated in the beginning, the over-sexualization of our culture, at least here in the U.S.

Only if that person asked for it, I would say. So in this case, with "adult conversations" being involved, probably so, but someone who just received a random uninvited message including a naked girl in a sexualized setting has not done anything to be guilty of -

In this particular issue, if it was my child, I would take a serious issue with them sending nude pictures of themselves and sending them to someone. If the pictures were sexually based or of that nature, it's one thing. If it's a picture to a friend where one is trying to say something along the lines of that nudity isn't something to be ashamed of, then it's a different issue, though I still wouldn't say that it's a good thing at that age. But that's just over the phone. If they posted it on the internet then he/she would be in trouble.

That used to be the standard, Mens Rea and Actus Reus (The Mental Intent) and (The Action), unfortunately today way too many crimes don't require the Mental Intent, but only the action...

I'd never heard of actus rea - thanks for that.

And I agree if someone randomly sent me a pic (which I have no control over) I would not expect to be sent to jail.

However I do believe in many instances that intent follows the bullet.

As for the child (pic sender) in this case - whether the image was sent in a sexual context or not she needs a an explanation of certain facts of life regarding the world she lives in.

That's a very good point, about having an explanation about the facts of the world, ToneBender. I think that there are a lot of teens and young adults who could have done with that explanation.

Though I'm wondering, how much difference would there be in attitudes towards sexting or sending nude photographs between young people raised nudist/naturist and those raised textile?

The people who are searching the internet, or those people who do those torrents and such and get kiddo-porn on their computer or in their cookies, don't expect to go to jail, but they do.

But, the same goes for the parents who take a nude picture of their child in the bath, they don't expect to get arrested either, but sometimes they do...

It is our over-sexualized and over-regulated country...

However that was written by a grade 11 student and that signifies to me that there's a debate among the youth of the world regarding (post-)post-modern feminism in the internet age. I think there will always be victims of the internet including cyber-bullying and cyber-male-chauvinism (and the elderly being defrauded of their savings for that matter) but maybe the youth can sort things out at least part of the way themselves.

I am well accustomed to this problem. Young girls sending nude photographs to people within in school is a massive problem in the area that i work in. There has been many times i have been called to a school to sort issues such as this out. Most of them do it because of peer pressure and it is shocking to see the lengths that they will go to.

I think a lot of young females need to learn that once a picture is out there it can spread in a matter of minutes and it may end up on the internet, i've seen pictures end up on Facebook to their horror.
